Supreme Court scheduled a hearing in respect of a well-known mark “Corvalol”

A hearing of the Supreme Court of Ukraine during which Farmak JSC will defend its intellectual property rights to a well-known mark “Corvalol Corvalolum” will be held on 09 October 2018.

Farmak JSC stands for a civilized competition and defends its rights to a well-known mark Corvalol Corvalolum”.

It is worth mentioning that upon the appeal of Darnitsa Pharmaceutical Firm, Kyiv Commercial Court of Appeal cancelled the judgement of the Appeals Chamber of the Ministry of Economic Development of Ukraine recognizing “СORVALOL CORVALOLUM” a well-known mark.
The motions of both the defendant – the Ministry of Economic Development and the third party – Farmak JSC were also dismissed, evidencing biased proceedings in the appellate instance.

Historically, mark “CORVALOL” for the drug product, which has been manufactured since 1960, is owned by Farmak. “Corvalol” was developed by Lomonosov Kyiv Chemical and Pharmaceutical Plant, which legal successor is Farmak JSC.

“We hope that the litigation in respect of a well-known mark “Corvalol Corvalolum” in the Supreme Court will be objective and impartial, given that the case might be considered by the Grand Chamber of the Supreme Court”, said Dmytro Taranchuk, Head of the Legal Department, Farmak JSC.

Farmak was established in 1925 on the basis of Lomonosov Kyiv Chemical and Pharmaceutical Plant specializing in the manufacture of pharmaceutical substances and radiopaque media on the territory of the former Soviet Union.

In 1995, the chemical plant was transformed into a robust pharmaceutical company with focus on manufacturing of finished dosage forms, which became the beginning of a new era in the company’s life.

Preparation for manufacturing of “Corvalol Corvalolum” was initiated by Lomonosov Kyiv Chemical and Pharmaceutical Plant, which legal successor is Farmak JSC. The drug product was developed by Senior Chemist V.Ya. Yakovleva. The first batch of the drug product “Corvalol” was released under the order of Lomonosov Plant dd. 15.10.1960. Since then, Lomonosov Plant was the only manufacturer of “Corvalol” in the former USSR.

Since 1991 to date, Farmak JSC has been the only manufacturer of this drug product on the territory of former Soviet Union.

Furthermore, “Corvalol” trademark is protected in 15 countries of Europe and Central Asia: Germany, Poland, Lithuania, Estonia, Latvia, Belarus, Moldova, Romania, Bulgaria, Turkmenistan, Armenia, Georgia, Azerbaijan, Tajikistan, Kyrgyzstan, and Kazakhstan. The use of the mark “Corvalol Corvalolum” is generally confirmed by packaging during the period from 1991 to 2001 inclusive.
