The court took into account the level of consumer awareness of the brand in the case of Corvalol M

The Commercial Court of Kyiv included in the case of the Corvalol brand the results of a consumer awareness level study regarding this brand.

In April 2017, Farmak JSC appealed to the Appeals Chamber of the Ministry of Economic Development and Trade (MEDT) to recognize the well-known Corvalol brand in Ukraine in the name of Farmak PJSC as of December 1, 2002, which was approved in an order of MEDT No. 1037 dated July 19, 2017.

The pharmaceutical company “Darnitsa” (Kiev) appealed to the Commercial Court of Kiev with a request to invalidate this decision of the Ministry of Economic Development and Trade, including motivating the claim that the popularity of the mark is not supported by actual data and evidence contained in the case file of the Ministry of Economic Development and Appeal.

On August 28, 2019, at the preparatory hearing about the well-known Corvalol trademark, during which the court considered 2 petitions. The first one – from pharmaceutical firm  Darnitsa on attracting Farmak JSC as a co-defendant in the case, and the second was a request from Farmak JSC to attach to the case materials the results of a sociological survey of consumers on the Corvalol trademark. Both applications were fully satisfied.

According to Dmitry Taranchuk, Director of Legal Support, Farmak JSC, the company protects its right to the well-known trademark“Corvalol”. This medicine was created in 1959 at the Kyiv Chemical and Pharmaceutical Plant, the rightful successor of which is Farmak JSC.

The next preparatory hearing will be held on September 4, 2019
